Preamble
These general terms and conditions of sale apply to any order placed by a consumer, within the meaning of European Directive No. 2011/83/EU of 25 October 2011, in respect of Products offered for sale on the Sitewww.BOBIJOO.fr(hereinafter "the Site") by :
ANGELYK (hereinafter " BOBIJOO "),
SAS with capital of €10,000.00,
Whose registered office is located at 8 route de Civeyrac, 43100 Paulhac - France,
Registered with the Registre du Commerce et des Sociétés de Le-Puy-en-Velay under number 799 983 978,
ANGELYK is the publisher of the Site (publication director: Franck Biscuit, Managing Director).
Article 1: Purpose
On the Site,BOBIJOO offers the sale of costume jewellery and accessories (hereinafter referred to as the "Products"), and services ancillary to these Products, to Internet users browsing the Site (hereinafter referred to as the "Customers").
The Customer is understood to be a natural person who is of legal age or at least has the legal capacity to contract and who is acting for purposes that do not fall within the scope of his or her commercial, industrial, craft or liberal profession activity.
For the purposes of this Agreement, it is agreed that the Customer and BOBIJOO shall be collectively referred to as the "Parties" and individually referred to as the "Party".
Any order for a Product placed on the Site is subject to these general terms and conditions of sale.
BOBIJOO reserves the right to modify these general terms and conditions of sale at any time by publishing a new version on the Site. The general terms and conditions of sale applicable are those in force on the date on which the order is placed.
The purpose of these general terms and conditions of sale is to define the rights and obligations of the Parties resulting from the online sale of Products offered on the Site.
They provide a framework for the steps necessary for the execution of the order between the parties.
Article 2: Products and availability
The Products are understood to be the articles distributed on the Site by BOBIJOO.
The Products offered on the Site are described and presented as accurately as possible.
Product offers are subject to availability.
BOBIJOO will make its best efforts to update its stocks and, if a Product is unavailable, to remove it from the Site. When a size of a Product is not available, the checkbox on the Product sheet cannot be selected.
In any event,BOBIJOO reserves the right to withdraw any Product from the Site at any time and/or to replace it or to adapt or modify any content or information relating to the Product appearing on the Site.
The Products remain the property of BOBIJOO until the price has been paid in full.
Article 3: Prices
The prices of the Products are indicated in euros, inclusive of all taxes (VAT) and exclusive of shipping and handling costs. The invoice for the order will be available in your Customer Area in the order history.
In the event of an order to a country other than mainland France, you are the importer of the Product(s) concerned.
For all Products shipped outside the European Union and DOM-TOM (French overseas departments and territories), the price will automatically be calculated exclusive of tax on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of BOBIJOO. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities/organisations in your country. We advise you to obtain information on these aspects from your local authorities.
BOBIJOO reserves the right to modify its prices at any time but the Products will be invoiced on the basis of the prices in force at the time your order is validated.
Article 4: Ordering
The availability of Products is displayed on the Site, on each product sheet.
In the event that, subsequent to your order, a Product or service becomes totally or partially unavailable due to a quality defect, stock shortage, etc., BOBIJOO will inform you by email of this unavailability and will give you the option of:
Either, if you accept it, to access a credit note for the amount of the product(s) not present in the parcel; you may, however, claim reimbursement of this credit note within 30 days.
Or to be reimbursed for the price of the product or service ordered, on simple request by e-mail to contact at BOBIJOO.fr.
All orders placed on the Site require the creation of a Customer Area. Access to your Customer Area is subject to your identification using the email address you provided when creating your account and the secret personal and confidential password you have chosen.
Do not communicate your Customer Area identifiers to third parties. BOBIJOO shall not be held liable for any action carried out via or on your Customer Area by a third party to whom you have communicated your identifiers or who has had access to your identifiers or to your Customer Account as a result of a fault or negligence attributable to you.
When you place your order, you must confirm it using the "double-click" technique: in other words, after selecting the Products added to your basket, you must check and, if necessary, correct the contents of your basket (in particular: identification and quantity of Products selected, corresponding prices, delivery methods and costs), before validating it, accepting these GTC by clicking on the "Proceed to payment" button, as indicated on the "Delivery method" page, and thus confirming acceptance of your order.
You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. Confirmation of your order therefore implies acceptance of these General Terms and Conditions of Sale.
Once your order has been placed, BOBIJOO will acknowledge receipt by sending you an initial order confirmation email containing a summary of your order and its number, and will then definitively validate your order by sending you a second order validation email.
BOBIJOO reserves the right not to validate your order for any legitimate reason, in particular in the event that :
- It does not comply with these GTC
- One of your previous orders has not been paid for in full by the due date,
- A dispute relating to the payment of one of your previous orders is being processed,
- Several serious and concordant elements give rise to a suspicion of fraud concerning your order.
- You may be legally required to provide supporting documents to validate an important order, i.e. send us an email to the following address: contact at BOBIJOO.fr with a copy/scanned copy of your ID + invoice showing the delivery address.
These emails are sent to the email address you use to log in to your Customer Area.
Please note: If you do not receive one of the two emails above, we recommend that you contact our Customer Service department.
Article 5: Payment
BOBIJOO offers you a choice of 4 payment methods to pay for your order:
- Payment by bank card (Sogecommerce - Société Générale)
For maximum security, we have chosen to use Sogecommerce as our secure payment solution. This system is developed by Société Générale. Security is provided by TLS (Transport Layer Security) encryption technology, a latest-generation solution that is currently the most reliable available for internet payments. Visa, Visa Electron, E-carte bleue, Mastercard and Maestro credit cards are accepted, as is payment via the Paylib system.
Sogecommerce, Société Générale's secure payment solution, is PCI DSS (Payement Card Industry Data Security Standard) certified. The PCI DSS standard has been adopted by the Mastercard and Visa networks to strengthen security in the use and storage of cardholder data. It is a global standard also supported by other networks such as American Express JCB and Diners.
3D Secure protocol: customer identification.
In order to significantly reduce fraud on the Internet, increase confidence in card payments and bolster the momentum of e-commerce, French banks have agreed to adopt new regulations governing bankcard payments on the Internet. These regulations are based on the "3D Secure" protocol developed by the 2 international card networks, Visa and Mastercard (known as Verified by Visa and Mastercard Secure code).
This protocol has been in place on the Sogecommerce payment platform for several years. Within the framework of this protocol, it is now up to the customer's bank to check the identity of the cardholder when paying on the Sogecommerce secure payment platform. This check is carried out by the customer's bank, directly on the Internet, using its own method (secret code, personal and confidential information, smart card reader, etc.).
- Payment with PayPal (PayPal account optional)
Secure payment with the "PayPal Intégral Évolution" solution offers you 2 possibilities:
1- If you have a PayPal account, all you have to do at the time of payment is identify yourself simply and completely securely.
2- If you do not have a PayPal account, you can pay for your order directly using your standard payment card (Visa, MasterCard, American Express, Discover, etc.).
- Payment by cheque
We only accept bank or postal cheques drawn on a bank in France.

Your order will be processed on receipt of your payment.
You have 7 days to send your cheque, after which your order will be automatically cancelled.
An email will be sent to you as soon as we receive your payment and your cheque will be cashed immediately.
- Payment by bank transfer
If you choose to pay by bank transfer, your payment details will automatically be sent to you.

Your order will be processed on receipt of your payment.
You have 15 days in which to make the transfer to our account, after which your order will be automatically cancelled.
An email will be sent to you as soon as we receive your payment on our bank account.
Article 6: Delivery
To have an order delivered, the Internet User is free to choose between home delivery, delivery to his/her place of work or to any other address of his/her choice stipulated at the time of ordering (your delivery address).
The order is sent to La Poste within 24 hours (working days), except in the case of force majeure which would delay delivery.
Please note that any order placed after Friday 1pm will not be sent until Monday of the following week. If there is likely to be a delay in delivery, BOBIJOO undertakes to notify the Internet User as soon as possible. In the event of a prolonged delay in delivery, the Internet User is invited to notify BOBIJOO Customer Services as soon as possible using the telephone number indicated in the order confirmation e-mail. BOBIJOO will then contact the postal services in order to open an investigation, it being specified that the time taken for a postal investigation may be long.

If your items have been dispatched, we cannot interrupt the delivery process, but you may return any products that you do not wish to keep. Please refer to the next Article (Article 7) of these terms and conditions.
Article 7: Right of withdrawal: 30-day money-back guarantee
In addition to the legal 14-day withdrawal period, BOBIJOO also offers the consumer a money-back guarantee for the following 16 days.
All Products delivered may be reimbursed except for those excluded by law in article L 121-21-8 of the French Consumer Code and bearing a mention to this effect, for example Products that have been personalised at the request of the User (engraving), as well as Products that cannot be returned for reasons of hygiene (piercing, etc.).
The Products must be in good condition, complete and packaged in their original packaging. The User has a period of 15 days from receipt of the last package of his/her order to notify his/her decision to cancel to the following address: contact at BOBIJOO.fr
To exercise his/her right of withdrawal, the User may either use the standard withdrawal form which can be downloaded by clicking here or make any unambiguous statement indicating his/her intention to return the product to us.
The User then has the right to return an item from their order, 15 days as from the sending of the notification of retraction (that is to say a total of thirty (30) days maximum as from the date of reception or of withdrawal of the last article of its order).
If the User has not notified ANGELYK of his/her decision, ANGELYK nevertheless agrees to take back the product if it is returned within 30 days of delivery.
During this period, the User may return the Products without having to justify his decision or pay a penalty.
The User may return the Product by post to ANGELYK - 8 route de Civeyrac - 43100 PAULHAC. The cost of returning the Product via La Poste is borne by the User (with the exception of a Product that is faulty on receipt, or an error when the Product was sent).
BOBIJOO undertakes to reimburse the User who has exercised his/her right of withdrawal as soon as possible and at the latest within 14 days of receipt of proof of dispatch of the returned Product or receipt of the Product by BOBIJOO (whichever is the earlier). The proofs of dispatch to be sent to us are: stamped and dated post office receipts, tracked parcel deposit.
BOBIJOO will reimburse the Customer for the Products returned, subject to compliance with the aforementioned conditions, as well as the standard "one-way" delivery costs for the latter if the User returns the entire order.
If the User does not return the entire order and retains one or more of the Products ordered, the amount of the one-way delivery charges will be retained by BOBIJOO.
As a reminder, returns by post remain the responsibility of the User.
Reimbursement will be made using the payment method for the returned order.
Article 8: Intellectual property
All the texts, comments, illustrations, images and photos offered on this site are published by BOBIJOO or its partners and remain their respective property.
In this respect, and in accordance with the provisions of the French Intellectual Property Code, any use, total or partial reproduction or public distribution of this information and documents is strictly prohibited without the prior authorisation of BOBIJOO.
Conversely, BOBIJOO respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, that your jewellery, accessory or trademark has been used without authorisation, or that your intellectual property rights have been violated please contact BOBIJOO with the following information:
- A description of the copyrighted work, trademark or other intellectual property that you claim has been infringed upon
- Your address, telephone number and e-mail address
- The link to the ad concerned
For clever people who want to reproduce our creations without our permission, please note that the "BOBIJOO Jewelry" brand is a registered trademark.
All our creations are also protected and our moulds have been made exclusively for us and under contract with our partners.
So you've been warned! :)
Article 9: Personal data
The French Data Protection Act sets out the principles to be observed when collecting, processing and storing personal data. It also guarantees a certain number of rights for the people concerned. Compliance with these principles will enable you to carry out your procedures.
Before any personal data is collected and used, the data controller must tell the data subjects precisely what it is going to be used for. These objectives, known as"purposes", must respect the rights and freedoms of individuals. They limit the way in which the data controller may use or re-use the data in the future.
PRINCIPLE NO. 2: RELEVANCE CHECK THE RELEVANCE OF THE DATA
Only data that is strictly necessary to achieve the objective may be collected: this is the principle of minimising data collection. The data controller must therefore not collect more data than is really necessary. They must also be aware of the sensitive nature of certain data.
PRINCIPLE NO. 3: DATA RETENTION LIMITING DATA RETENTION
Once the purpose for which the data was collected has been achieved, there is no longer any point in keeping it and it must be deleted. This retention period must be defined in advance by the data controller, taking into account any obligations to retain certain data.
PRINCIPLE NO. 4: RIGHTS RESPECTING PEOPLE'S RIGHTS
Data concerning individuals may be collected on the essential condition that they have been informed of the operation. Individuals also have certain rights that they can exercise with the organisation holding the data: the right to access the data, the right to rectify it and the right to object to its use.
PRINCIPLE NO. 5: SECURITY SECURING DATA
The data controller must take all necessary measures to guarantee the security and confidentiality of the data it has collected, i.e. ensure that only authorised persons have access to it. These measures may be determined on the basis of the risks weighing on the file (sensitivity of the data, purpose of the processing, etc.).
Article 10: Liability
For all stages of access to the Website, consultation, completion of forms, placing of orders, delivery of items or any other service, BOBIJOO has only a best endeavours obligation.
Thus, BOBIJOO undertakes to describe the Products sold on the Website as accurately as possible. However, BOBIJOO shall not be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure as defined by French case law.
Similarly, BOBIJOO may not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.
BOBIJOO reserves the right to refuse to make a delivery or to honour an order from a consumer who has not paid in full or in part for a previous order or with whom a payment dispute is being administered.
BOBIJOO checks all orders that have been validated on its site. The purpose of these checks is to protect BOBIJOO abusive practices by fraudsters. Our services may ask you to provide all the documents required to unblock your order: proof of residence or debit in your name, or proof of residence in the name of the person indicated for the delivery address, etc.
Article 11: Applicable law - Jurisdiction
The Contract is subject to French law (excluding the rules applicable to conflicts of law).
In the event of a dispute, an amicable solution will be sought. Our Customer Service department will be happy to help.
If the dispute remains unresolved, only the French courts will have jurisdiction.
Article 12: Final provision
If any of these provisions cannot, for any reason whatsoever, be fulfilled, the validity of the other provisions will not be affected.
